Dreamgates – Terms of Service

Welcome to Dreamgates. These Terms of Service govern your access to and use of the Dreamgates mobile application and its related services provided by Ealith.

By downloading, accessing, or using the Service, you signify your agreement to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

Dreamgates is a premium music and ambient sound streaming application designed for focus, relaxation, and sleep. The Service includes:

• A curated selection of radio stations (some free, others available via subscription).
• A library of ambient sound effects to layer with music.
• Sleep timer and focus session functionalities.
• An interactive live chat community feature.
• Full media controls for background streaming and lock screen playback.

2. User Accounts

2.1. Account Creation and Responsibility To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your password and account credentials.
• Accept full responsibility for all activities that occur under your account.
• Notify us immediately of any suspected or actual unauthorized use of your account.

2.2. Eligibility You must be at least 13 years old to create an account and use the Service. You may not maintain more than one account per person. Accounts are non-transferable.

3. Acceptable Use Policy

3.1. Permitted Use We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial purposes, strictly in accordance with these Terms.

3.2. Prohibited Activities You agree that you will not engage in any of the following prohibited activities:

• Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Harassing, threatening, demeaning, embarrassing, or causing distress or discomfort to other users.
• Posting, sharing, or transmitting any content that is unlawful, offensive, hateful, defamatory, obscene, or otherwise objectionable in the chat features.
• Attempting to gain unauthorized access to the Service, other users’ accounts, or our computer systems or networks.
• Interfering with, disrupting, or creating an undue burden on the Service or the servers and networks connected to it.
• Using any automated system, including “bots,” “spiders,” or “scrapers,” to access, monitor, or copy any part of the Service.
• Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code of the Application.
• Removing, altering, or obscuring any copyright, trademark, or other proprietary notices on the Application.

4. Premium Subscription

4.1. Premium Features A subscription to Dreamgates Premium (“Subscription”) unlocks access to exclusive features, including all radio stations, an ad-free experience, unlimited chat access, and priority support.

4.2. Billing, Renewals, and Payment

• Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually).
• Payment will be processed through the third-party app store from which you downloaded the Application (e.g., Apple App Store or Google Play Store).
• Your Subscription will automatically renew at the end of each billing period unless you cancel it through your app store settings at least 24 hours before the end of the current period.
• We reserve the right to change our subscription prices. We will provide you with at least 30 days’ notice of any price changes.

4.3. Cancellation You may cancel your Subscription at any time. The cancellation will take effect at the end of the current billing period. Subscription fees are non-refundable, except as required by law.

5. Intellectual Property

5.1. Our Content All materials within the Service, including the music, sound effects, text, graphics, logos, and software, are the property of Ealith or its licensors and are protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our express written permission.

5.2. User-Generated Content You retain ownership of the content you create and share, such as chat messages (“User Content”). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and providing the Service. You are solely responsible for your User Content and must ensure it does not violate these Terms or any applicable laws.

6. Disclaimers and Limitation of Liability

6.1. Disclaimer of Warranties THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

6.2. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EALITH, ITS DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

7. Termination

7.1. Termination by You You may terminate your account and stop using the Service at any time by following the account deletion process outlined in our Privacy Policy.

7.2. Termination by Us We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms.

8. Changes to These Terms

We may modify these Terms from time to time. We will notify you of any material changes by providing a notice within the Application or by other means. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ealith regarding the Service and supersede all prior agreements and understandings.
